Whether it’s the rape of a child, human trafficking, the drowning of kittens, or cruelty to an elder, most of us have a crime that tests our ability to appreciate the Eighth Amendment which prevents cruel and unusual punishment. It’s one of the principles of a civil society and why we’ve agreed to live under the guidance of our Constitution.
It’s good to have debates about the Constitution and a great deal of Court time has been spent determining whether specific punishments are “cruel and unusual.” However, the underlying assumption …. always … is that “due process” has occurred. Only AFTER guilt has been determined by due process can the question of appropriate punishment be determined.
This is where the trump regime continues to … … … well, there’s no other way of saying it … lie and ignore the Constitution. They refer to Kilmar Abrego Garcia as a terrorist and gang member but have refused to give him any due process rights, which makes us question their integrity and puts all of us at risk of being treated similarly should we run askew of the current regime’s favor.
They admitted they made a mistake in sending Abrego Garcia there and are now inventing reasons why they can’t bring him back. We’re left speculating while leaving an innocent man in hell.
New: Sen. Chris Van Hollen (D-Md.) says he is leaving for El Salvador today (4/16/2025) and has asked for a meeting with President Bukele. Reps. Robert Garcia (D-Calif.) and Maxwell Frost (D-Fla.) asked House Oversight Committee chair James Comer (R-Ky.) to approve an official delegation to the prison where Abrego Garcia is imprisoned. Sen. Cory Booker (D-N.J.) is also trying to lead a trip there.
Federal Judge Paula Xinis today scheduled an intense two weeks of discovery to determine what actions have been taken to bring Abrego Garcia home.
Abrego Garcia, without ANY due process, is being held in CECOT maximum security gulag,* where prisoners are confined to cells for all but 30-minutes per day, sleep on cots without mattresses, eat beans or pasta (no meat), receive no calls, and are there for life. Abrego Garcia is a husband, father, worker, and human being living in Maryland prior to being kidnapped to El Salvador without due process.

Trump and crew have danced around the Supreme Court’s orders to return Abrego Garcia. A lot of us are holding our breath not only for the sake of this wrongly imprisoned man, but also for all the men from our country who are being imprisoned there without the benefit of due process. It is reported that 90% of them have no US criminal records.
Even if every person sent there had due process criminal records, this prison should be deemed “cruel and unusual punishment.” However Trump “joked” with Bukele that “homegrown” US criminals should be imprisoned under similar conditions and that Bukele might have to build more. Our tax dollars are paying for this cruelty.

During the tour, prison director Belarmino Garcia referred to the inmates as "psychopaths who will be difficult to rehabilitate," adding: "That's why they are here, in a maximum security prison that they will never leave." (emphasis added)
Over 80,000 Salvadorans have been detained since Bukele declared the state of emergency.
The Socorro Juridico Humanitario rights group estimates that almost a third of those detained are innocent.
